1) Mr. Gawankar, learned counsel appearing for Applicant fairly submitted that, as of today the Applicant has undergone imprisonment of 9 years and to avail the benefit of guidelines issued by the Hon'ble Supreme Court in the case of Saudan Singh Vs. The State of Uttar Pradesh in Criminal Appeal No. 308 of 2022 [@ SLP (Crl.) No. 4633 of 2021], dated 25 th February 2022, the Applicant is ready and willing to wait for a year more. 1.1) He therefore seeks leave to withdraw application with liberty to file a fresh application for bail after the Applicant completes incarceration of 10 years.
