This is an application under Section 438 of Code of Criminal Procedure for anticipatory bail.

The applicants are apprehending their arrest in Crime No.255 of 2020 registered at Umadi Police Station, Dist. Sangli for the ofences punishable under Sections 419, 420, 463,465, 468 read with 34 of the Indian Penal Code (IPC).

This Court on 6 June 2022 passed the following order. "Heard Mr. Satyavrat Joshi, learned counsel for the applicants and Mr. Dabholkar, learned Additional Public Prosecutor for the State.

Mr. Dabholkar, learned prosecutor, seeks time to take instructions. Time granted. Pending Anticipatory Bail Application, the learned Trial Court Dinesh S. Sherla 1/2

10-ABA-1450-22.doc had granted interim pre-arrest protection to the applicants, which is in force till today. In consideration of these facts, list the application for further consideration on 21st June, 2022.

Till then, in the event of arrest of the applicants, they shall be released on executing the P.R.Bond in the sum of Rs.20,000/- each with one or more sureties in like sum.

The applicants shall join the investigation as and when called.

5 The applicants shall not tamper with the evidence or attempt to infuence or contact the complainant, witnesses or any person concerned with the case. Stand over to 21st June, 2022."

I have perused the FIR. The main reason for fling the FIR appears to be dispute between the Managing Committee of the Educational Trust viz., Late Ramchandra Patil Shikshan Sanstha, Kunikonur, Dist. Sangli. It appears that in relation to said dispute change reports are pending before the Charity Commissioner. There appears to be no need of custodial interrogation. Considering the overall facts and circumstances of the case, I am inclined to allow the present application. Accordingly, the interim anticipatory bail granted to the applicants by order dated 6 June 2022 is hereby confrmed subject to the applicants paying Rs.25,000/- each to Kirtikar Law Library within three weeks from today.
