The application is moved for condonation of delay of 236 days in preferring the first appeal, which is filed for enhancement of compensation that was awarded by the Motor Accident Claims Tribunal, Kolhapur. Though served, the respondents are not present. 2.

The learned Counsel for the applicant submits that the applicant is disabled 100% and his left leg is amputated due to the accident; so also, he has financial constraints and hence, there is a delay. 3.

In view of the submissions of the learned Counsel for the applicant and considering the physical disability of the applicant, the delay of 236 1 / 2
