The learned Counsel for the applicant fairly submits that in the present case, the learned Sessions Court has completed the recording of evidence and the matter is posted for final hearing. In view of this,it would not be appropriate to hear the application under section 439 of the Code of Criminal Procedure, 1973. Hence, the learned Counsel upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted. The application stands dismissed as withdrawn and disposed of accordingly.
