This is an application for modification of the condition No.23(iv) imposed upon the applicant while releasing him on bail. The said condition reads as under:- "The applicants shall attend the office of the concerned investigating agency at Mumbai on every first Sunday of each month between 10.00 a.m. to 12.00 noon, till the conclusion of the trial".

The learned counsel for the applicant submitted that, since the date of release from the Jail the applicant is sincerely attending the concerned investigating agency. She Page-1/2

37-appp-397-16 further submitted that the applicant is also attending all the dates before the Trial Court and as of today 90 witnesses have been examined by the prosecution and prosecution may examine about 25 more witnesses. The fact that the applicant is sincerely attending the Trial Court and has complied with the condition imposed upon him, I am inclined to modify the said condition.

The condition No.23(iv) is hereby waived and the applicant is hereinafter directed to attend the Trial Court on all the dates without any excuse unless precluded for medical reasons.

Application is accordingly allowed.
