Heard learned counsel for the applicant and the learned APP for the respondent - State. 2.
By this application, the applicant seeks relaxation of the condition imposed by clause(iii) of para 9 of the order dated 30.04.2015. Clause(iii) of para 9 of the order dated 30.04.2015 of which relaxation is sought reads thus:-
"(iii) The applicant shall not enter the jurisdiction of the Chembur Police Station, till the conclusion of the trial."
Learned counsel for the applicant states that the applicant has received a Show Cause Notice issued by the Assistant Commissioner of Police and Special Executive Magistrate, Chembur Division, under Section 59 of the Maharashtra Police Act, 1951. He submits that pursuant to the said notice, the applicant will be required to appear before the ACP and the Special Executive Magistrate.

Learned APP on the instructions of the officer, who is present in Court, states that the applicant be permitted to enter the jurisdiction of the Chembur Police Station only on such dates, as are given for hearing of the said Show Cause Notice issued under Section 59 of the Maharashtra Police Act, 1951.

Accordingly, the condition imposed vide clause (iii) of para 9 of the said order dated 30.04.2014 is modified/relaxed to the extent, that the applicant is now permitted to enter the jurisdiction of the Chembur Police Station, only on such dates given by the Assistant Commissioner of Police, Chembur Division for hearing of the Show Cause Notice. The applicant shall enter the jurisdiction of the Chembur Police Station, to attend the office of the Assistant Commissioner of Police, Zone VI, Chembur Division, on every date, a little before the hearing of the Show Cause Notice and shall leave the jurisdiction of the Chembur Police Station, immediately after the hearing. It is made clear, that the said condition imposed in Clause(iii) of para 9 is relaxed/modified only for the hearing of the said Show Cause Notice issued under Section 59 of the Maharashtra Police Act, 1951.

The Application is allowed & disposed of in the aforesaid terms.
