By the impugned Order dated 15.12.2015 the complaint filed by the petitioner stands dismissed by the learned Judicial Magistrate First Class, Kudal, District Sindhudurga.

The record indicates that, on the basis of the private complaint filed by the petitioner and upon the order passed by the learned Magistrate the police submitted report under Section 202 of the Cr.P.C. stating that there is no evidence to substantiate the allegations made by the petitioner in the complaint. The record further indicates that, the petitioner further failed to adduce additional evidence in support of his case. It further appears from the record that, there is 1/2
Nalawade 2 21-wp-2129-18.doc dispute between two groups of trustees to have control over the trust in question and out of the said dispute the present complaint had been instituted by the petitioner.

As noted earlier the petitioner has failed to produce any cogent and substantial evidence before the Trial Court in support of his complaint and therefore, the learned Magistrate was pleased to dismiss the same. I find that the order passed by the learned Magistrate is a proper order and there is no error either in law or on facts committed by it.

The petition is accordingly rejected.
