On 3.1.2023, none appeared for the Petitioner, so also today. 3.

Petitioner has sought issuance of directions to Respondent No.3 i.e. the Superintendent of Rescue Foundation, Mumbai, to release the victim girl namely Indira who was rescued in offence No.97 of 2016 punishable under Section 370-A(1), 372, 34 of the Indian Penal Code, Sections 4 and 5 of the Immoral Traffic (Prevention) Act, 1956 and Sections 4, 8, 17 of the Protection of Children from Sexual Offences Act. 4.

In response to Court's directions, learned APP, on instructions from the police official informs that the Sessions Court, vide order dated Chitra Sonawane.

2/2 5-WP-1846-2016.doc 20.4.2016, has already ordered handing over the custody of the victim girl to her father i.e. the Petitioner herein. As the victim girl was minor, custody was not handed over to the Petitioner by the Child Welfare Committee and accordingly, the Report was submitted to the Sessions Court.

As none appears for the Petitioner and it appears that custody of the victim girl is already received by the Petitioner-father pursuant to the order dated 20.4.2016, nothing survives in the present petition. The Petition, as such, stands disposed of.
