Heard the learned Counsel for the applicant and the learned APP for State.

This is an application seeking condonation of delay in filing an application seeking leave to appeal, thereby challenging the Judgment and Order dated 1/12/2016 passed by the JMFC, Vashi, thereby acquitting the respondent under section 500 of the Indian Penal Code. The delay is of 83 days. For the reasons assigned in paragraphs- 3 to 5, the application seeking condonation of delay deserves to be allowed. Learned Counsel for the respondent vehemently submits that the delay has not been properly explained. However, the matter can be Talwalkar
