Parties through their Counsel. Learned Senior Counsel for the Petitioner has placed on record a letter dated 18th May, 2016, which has been filed along with the affidavit dated 10th June, 2016. In view of the aforesaid letter according to the learned Senior Counsel for the Petitioner, the Respondent Navi Mumbai Municipal Corporation has withdrawn its earlier impugned final notice. He, therefore, submits that in view of the aforesaid position nothing survives in the Petition.

Learned Counsel for the Respondents on telephonic instructions received from the Respondents has not disputed the issuance of the said letter dated 18th May, 2016 which has been filed along with the affidavit dated 10th June, 2016. In view of the aforesaid position we dispose of this Petition as having been rendered infructuous.
