This is an application under Section 439 of Code of Criminal Procedure (Cr.P.C.) for bail.

The applicant came to be arrested in Crime No. 26 of 2021 registered at Coastal Police Station, Moti Daman for the ofences punishable under Section 302 and 120-B read with 34 of the Indian Penal Code (IPC).

I have heard the learned counsel for the applicant and the learned standing counsel for respondent No.2. 4.
The deceased was the elder brother of the present applicant. According to the prosecution, the deceased was addicted to liquor. After consuming liquor, he used to quarrel with the present applicant and other family members. It is alleged that applicant had, therefore, hatched the conspiracy with the co-accused to kill Dinesh S. Sherla 1/2
36-ba-1681-22.doc the deceased and pursuant to the said conspiracy, on 9 October 2021 committed the murder of the deceased by strangulating him.

Admittedly, the case is based on circumstantial evidence. It appears that Sessions Court has granted bail to coaccused. Considering the facts and circumstances of the case, I am inclined to release the applicant on bail. In the result, the following order is passed.
O R D E R
A] Bail Application is allowed.
B] The applicant be released on bail in C.R. No.26 of 2021 registered at Coastal Police Station, Moti Daman for the ofences punishable under Section 302 and 120-B read with 34 of the IPC on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
