The Applicant was granted interim protection by order dated 13th January 2017 in Anticipatory Bail Application No.2023 of 2016. The said interim protection was granted on the basis of statement made by learned advocate for Applicant that the Applicant would deposit amount involved in the complaint. On the earlier occasion, the Applicant had made part payment to the complainant by way of demand draft. The undisputed balance amount which is to be paid is Rs.7.25 lakh as recorded in the order dated 4th April 2017. 2.

The Applicant has preferred Criminal Application No.437 of 2017 seeking extension of time to make the said payment. It is submitted that the Applicant is in financial crisis and, therefore, could not deposit the stipulated amount.

Learned APP opposed the application for extension of time on the ground that sufficient time was given to the Applicant to make payment. Learned advocate for complainant also opposed the prayer, however, he submitted that at the most, four weeks time may be granted to the Applicant.

Taking into consideration the aforesaid facts, I am inclined to grant further time to the Applicant to deposit the balance sum of Rs.7.25 lakh as a last chance. Hence, I pass following order :

ORDER

(a) Time to deposit the balance amount of Rs.7.25 lakh is extended till 23rd July 2017. It is made clear that no further time will be granted;

(b) It is made clear that if amount is not deposited on or before 23rd July 2017, the interim order dated 13th January 2017 will stand vacated;

(c) Interim protection granted earlier to Applicant, shall continue to operate till next date of hearing. Stand over to 24th July 2017. List Anticipatory Bail Application No.2023 of 2016 on 24th July 2017;

(d) Criminal Application No.437 of 2017 stands disposed of. (PRAKASH D. NAIK, J.) MST
