Heard learned counsel for the petitioner.

By this petition, the petitioner seeks expeditious disposal of case No. 738/S/2002 and prays that the said case be disposed of within six months.

Perused the papers. The petitioner is the original complainant, who had filed a case in the Magistrate Court, Girgaon, Mumbai, in September, 2000; and the learned Judge issued process as against the SQ Pathan 1/2

wp.1980.17.16.doc accused in the said complaint on 26th September, 2000. In August, 2006, the complaint was transferred to the Court of the Metropolitan Magistrate, 14th Court, Girgaon, Mumbai and was renumbered as case No. 738/S/2002. On 4th April, 2008 the petitioner filed an affidavit in lieu of examination-inchief along with compilation of documents before the learned Magistrate and that presently the cross-examination of the petitioner is going on. The case is of the year 2000 and there is hardly any progress in the said case, although the trial has commenced and the petitioner is in the witness-box. Considering the aforesaid, the petition is allowed and the learned Metropolitan Magistrate, 14th Court, Girgaon, Mumbai, to dispose of case No. 738/S/2002 as expeditiously as possible and in any event, within six months from the date of receipt of this order. The petition is disposed of on the aforesaid terms. All concerned to act on the authenticated copy of this order. REVATI MOHITE DERE, J.
