The applicant seeks condonation of delay of 120 days in filing the second appeal. The applicant has explained the delay in filing the second appeal in paragraphs 8 and 9 of the civil application. For the reasons recorded in the civil application, the civil application is made absolute in terms of prayer clause (a). There shall be no order as to costs.
