Heard. The learned AGP submits that they have already deposited the entire awarded amount in the Reference Court.

The statement is accepted.

Considering the submissions made by the learned AGP, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) The Civil Application is allowed in terms of prayer clause (a), which reads thus:

"(b) that this Hon'ble Court be pleased to stay the operation, execution and implementation of the Basavraj G. Patil 1/2

33.3712.13-caf.doc judgment and award dated 31.12.2012 passed by the learned Civil Judge, Senior Division, Kolhapur in LAR No.03/2009, till the hearing and final disposal of the above mentioned First Appeal."

b) The Tribunal is directed to invest the awarded amount in a fixed deposit account of any Nationalized Bank, initially for a period of one year and same shall be renewed from time to time till further orders.

c) Liberty granted to the claimants to prefer an appropriate Application for withdrawal of further amount, if they so desire, which will be decided on its own merits d) Civil application stands disposed of accordingly.
