Petitioner No.1 is present with his Advocate. Respondent No.3 is present with her Advocate. Learned APP appears for Respondent Nos.1 & 2.

Respondent No.3 has tendered affidavit giving no objection for quashing of charge-sheet dated 22.12.2013 under Sections 498-A, 377, 312, 313, 504, 506 & 34 of the IPC filed initially in the Court of JMFC, Panvel. It is not in dispute that now the case has been registered as Sessions Case No. 129 of 2019 and thereafter case was registered as Sessions Case No. 6 of 2015 and now the Sessions trial is pending. 1/2

Marriage between the parties is dissolved by Judgment dated 21.03.2017 in Petition No. F-1708 of 2016 by Family Court at Bandra. 5.

Respondent No.3 has today given an affidavit giving no objection for allowing the Petition. Orally also she has reiterated the same. 6.

Accepting the joint request, we make Rule absolute in terms of prayer clause (a).
