Heard learned counsel for the parties.

By this Application, the Applicants seeks suspension of her sentence and enlargement on bail pending the hearing and final disposal of the aforesaid Appeal.

Learned counsel for the Applicant submits that the Applicant was on bail pending the trial and has not abused or misused the conditions of bail.

Learned APP does not dispute the same.

Perused the papers.

The Appeal has been admitted by this Court vide Order dated 22.05.2017.

The Applicant vide Judgment and Order dated 28.04.2017 passed by the learned Additional Sessions Judge, Greater Mumbai has been convicted and sentenced as under :- - For the offence punishable under Sections 120B and 115 r/w.120B of the Indian Penal Code to suffer R.I. for a period of three years and to pay fine of Rs.5,000/-, in default to suffer S.I. for a period of six months 8.

After the conviction and sentence was awarded, the Applicant's sentence was suspended for a period of four weeks to enable her to file an Appeal.

Considering the fact, that the sentence imposed is a short term sentence and the fact that the Appeal is not likely to be heard in the immediate near future and the fact that the Applicant was on bail pending the trial and has not abused or

misused the conditions of bail, the Applicant's sentence is suspended and she is enlarged on bail, pending the hearing and final disposal of his Appeal on the following terms & conditions:- O R D E R (i) The Applicant be enlarged on bail, on executing PR Bond in the sum of Rs.15,000/- with one or two sureties in the like amount.

Accordingly, the Application is disposed of on the aforesaid terms.
