Mr. Tajane, learned Advocate appearing for the Appellant tenders letter dated 5th December, 2022 addressed by son of the Appellant. The said letter states that the sole Appellant has expired and parties have also settled the dispute and therefore leave to withdraw the Second Appeal is sought. The said letter is taken on record and marked 'X' for identification. 2.

The Second Appeal has abated as the sole Appellant passed away.

As the dispute is settled, the legal heirs of sole Appellant are not intending to pursue the Second Appeal and therefore, leave to withdraw the Second Appeal is granted. 4.

Second Appeal is accordingly dismissed.
