Mr. Bhatt, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file private complaint so far as relief claimed under prayer clause (c) is concerned. Leave with liberty as prayed for, is granted. The writ petition stands dismissed as withdrawn. 2.

Needless to mention that in case the petitioner's files a private complaint in respect of relief claimed under prayer clause (c), the learned Magistrate shall decide the same on its own merits and without being influenced by this order.

Interim relief, if any, stands vacated.

In view of disposal of the petition, civil application No. 352 of 2014 will not survive for consideration and same is, accordingly, dismissed.
