This matter was called out in the morning session when the request was made to adjourn the matter. Adjournment was opposed by the learned Counsel for Respondent - Complainant stating that the matter is being adjourned needlessly. From the perusal of roznama, we find that his grievance is correct and on several occasions, none had appeared for the Petitioners. Yet the matter was kept back in the afternoon session to enable the learned Counsel for the Petitioners to argue the matter.

It was informed that the advocate who was to argue the petition is not in India and neither he has given any instructions nor made any alternate arrangements. The advocate who is present has no instructions to go on with the matter. In light of the same, we left with no option but to dismiss the petition for non-prosecution. 3.
