The Applicant, apprehending arrest, in connection with the investigation of Crime No.11 of 2020 registered with Chandgad Police Station, under Section 418, 420, 466, 467, 468, 201 read with Section 34 of the Indian Penal Code is seeking anticipatory bail.

The said FIR is registered on the basis of the order passed by the learned Magistrate under Section 156(3) of Cr.P.C. According to the prosecution the Applicant had managed to get land Gut No.2, Survey No.1B/1/1 of Village Waghotre, TalukaChandgad recorded in the name of his father. N.S. Kamble page 1 of 2

I have heard learned counsel for the parties. Perused record.

The record discloses that by a detailed order this Court had granted interim protection to the Applicant on 30 June 2021 inter alia on the condition of attendance. It is not disputed that the Applicant has accordingly attended and cooperated with the investigation. Prima facie it appears that the land was recorded in the name of the father of the Applicant and not in the name of the Applicant. This Court had noticed that the only role was that the Applicant was present in the office of the Talathi. The Applicant is not stated to be the beneficiary of the mutation. The father of the Applicant was arrested and has been released on bail. In that view of the matter, the Criminal Application is disposed of in terms of the order dated 30 June 2021 subject to the condition that the Applicant shall continue to co-operate with the investigating agency and shall not tamper with the prosecution evidence/witnesses.
