Learned APP, on instructions, stated that the State has not preferred any appeal challenging the acquittal of the applicant for the offence under section 307 of IPC. The report addressed by the Assistant Police Inspector, Kashimira Police Station, Thane is taken on record and marked "X" for identification. Though none is present for the applicant in this application for suspension of substantive sentence, it is a factual position that the bail is already granted by the Court during the pendency of the appeal vide order dated 16th June,2015. As such on grant of bail during pendency of the appeal, the substantive sentence is automatically suspended. Hence, the present application is accordingly disposed of. (A.R.JOSHI, J.) 1/1
