This Writ Petition is allowed in terms of the following order.

ORDER

The amount of Rs.67 Lacs (Rs. Sixty Seven Lacs) deposited by the Respondent-Accused shall be handed over to the Petitioner-Complainant on following conditions;

(a) The Complainant shall submit an undertaking that he will re-deposit the amount in this Court if the Criminal Appeal succeeds.

(b) The Complainant shall also, in addition to submitting the undertaking, submit a Bank Guarantee of Rs.20 Lacs (Rs. Twenty Lacs) to the satisfaction of the learned Sessions Judge.
