Heard, both the applications for condonation of delay of 353 days in preferring the appeal challenging the order of acquittal of the respondents. It appears that the delay is caused for contacting the Advocate after obtaining the certified copies and in between loosing some of the legal documents and again obtaining fresh documents and sending them to the advocate. In both the matters the dishonored cheques are Rs.3 lakhs each.

Considering the grounds in the opinion of this court the main matter can be disposed of on merits. Hence, the N.S. Kamble page 1 of 2

37-appln-254-2014 and 38-appln-255-2014 applications for condonation of delay are allowed with following order.

ORDER

(i) Both the applications are allowed. Delay is condoned.

(ii) Both the applications for leave to file appeal are stand over to 20th July 2015.

(iii) Same respondent in both the matters shall waives service of the application for leave to file appeal.

(iv) The learned APP for respondent-States waives service in both the matters.

(v) Stand over to 20th July 2015.
