(1) Heard learned counsel for the applicant and the learned APP.
(2) The applicant has been convicted for the offence punishable under Section 7 and 13 (1) (d) of the Prevention of Corruption Act, 1988 ("the Act" for short). For the offence punishable under section 7 of the Act, the applicant has been sentenced to suffer rigorous imprisonment (RI) for a period of one year and to pay a fine of Rs. 500/- and in default to further undergo SI for a period of 15 days, while for the offence under Section 13 (1) (d) of the Act, the applicant has been sentenced to suffer RI for a
2 /2 911-appa-758-17.doc period of two years and to pay fine of Rs.1000/- and in default to undergo further SI for one month. The applicant has deposited the amount of fine of Rs.1500/- and a copy of receipt is produced which is taken on record and marked "X" for identification. (3) The applicant was all along on bail during the course of trial before the learned Special Judge. The learned Special Judge had granted suspension of sentence till the appeal period is over. Having heard the learned Counsel for the applicant and the learned APP, the application is disposed of by passing the following order; ORDER.
(i) The substantive sentence of imprisonment awarded to the applicant is hereby suspended, subject to the applicant furnishing a P.R. bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount;
(ii) The bail bonds to be furnished before the learned Special Judge; and (iii) All the concerned to act upon an authenticated copy of this order.
