Heard. This is an application under section 438 of Code of Criminal Procedure, 1973. Applicant herein is apprehending his arrest in crime no. 67 of 2015 registered at Kanjurmarg Police Station for offence punishable under sections 420, 464, 465, 468, 471, 474 r/w 120 (b) of Indian Penal Code. 2) On the last occasion, this Court had observed that the dispute is within the family between two brothers. That they were given an opportunity to explore the possibilities of an amicable settlement. Today, respective counsel submit that parties have arrived at an amicable settlement. Consent terms are filed on record. Consent terms are taken on record and marked as article 'X' ism

2 8.765.15 aba for the purpose of identification. Respective Counsel, upon instructions from the parties concerned, make a statement that they would abide by the consent terms in letter and spirit.

3) In view of this, application deserves to be allowed.

O R D E R

(i) Application is allowed.

(ii) In the event of arrest, applicant be enlarged on bail on furnishing P. R. bond in the sum of Rs. 25,000/- with one or two sureties in the like amount.

(iii) Applicant shall report to concerned police station as and when called.

(iv) Application stands disposed of.
