Heard the learned counsel for the appellant and learned counsel for the respondent Nos.2 and 3 (Original claimants). 2.

There is delay of about 100 days in instituting the appeal. The reason for such delay has been set out in paragraph Nos.1,2, and 3. This is basically a case where the office of the Insurance Company was required to be shifted and in the bargain, N.S. Kamble page 1 of 2

59-caf-3623-2016 there was delay in the institution of the appeal. 3.

The learned counsel for the applicant states that all the respondents are served. The learned counsel for respondent Nos.2 and 3 leaves it to the Court to consider the issue of condonation of delay. In the aforesaid circumstances, the delay is condoned subject to payment of costs of Rs.3,500/-. The costs to be paid to respondent Nos.2 and 3 or deposited in this Court within a period of four weeks from today, so that respondent Nos.2 and 3 can withdraw such amount.
