IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION Amk CRIMINAL WRIT PETITION NO. 1864 OF 2016 The State of Maharashtra .. Petitioner Vs.

Dattatraya Annasaheb Gaikwad & Anr.

.. Respondents Mr. H. J. Dedhia, APP for the Petitioner-State. Mr. Nitin P. Kulkarni for Respondent No.1.

CORAM : SMT. BHARATI DANGRE, J.

DATE : 25 th SEPTEMBER, 2019.

P. C. :

1.

The State is aggrieved by the order passed by the Industrial Court in Revision Application (ULP) No. 107 of 2012 dated 20.11.2012 and the order dated 14.01.2016 passed in Review Application (ULP) No. 11 of 2015.

2.

Learned APP makes a statement that the employees who were directed to be regularized in terms of the order of the Labour Court which was subsequently upheld by the Industrial Court and in relation to the compliance proceedings were initiated under the MRTU and PULP Act has been complied with. He also states that the State Government regularized their services long back by issuing a Resolution 1/2

(902) WP 1864-16 dated 18.07.2013. It is surprising that the State Government has taken pains to file Criminal Writ Petition in the year 2016 and instead it would have invited attention of the Labour Court and pointed out the compliance of the order.

3.

In light of the said statement, with liberty to the Petitioner to take out an appropriate application before the Labour Court, the present Writ Petition stands disposed of.
