The petition is filed for quashing the FIR bearing CR No.I 26 of 2018 registered with Kopri Police Station, Thane. This petition is already admitted and interim order is passed directing the Investigating Agency not to file charge-sheet. 2.
On 13th March 2019 after hearing both sides we pass following order :- "1.
Mr.Saste, learned APP, having taken instructions from the Officer concerned, makes a statement that the investigation into the subject N.S. Kamble page 1 of 3
FIR bearing No. I-26/2018 registered with Kopri Police Station is already completed and the police proposes to file "C" Summary Report. Statement accepted.

In light of above, Kopri Police Station is permitted to file "C" Summary report and to that extent, we modify the interim order dated 25th June 2018.

For further hearing, stand over to 25th March 2019."

Mr.Saste, learned APP now placed on record the report of the Police Inspector of Kopri Police Station dated 01.04.2019. The report shows that they proposed to file 'C' Summary Report in subject FIR. Mr.Saste, on instructions makes a statement that the proposal of the Investigating Agency is however, pending with the Superior Officer and it would be filed 'C' Summary Report after it is approved by the senior officer.

In light of the statement, the learned counsel for the petitioner fairly conceded the grievance of the petitioner in the petition which no more survives. The petition is disposed of. N.S. Kamble page 2 of 3

Needless to mention that the respondent No.2 who is the original complainant, has liberty to contest the Summary Report before the Magistrate.
