The applicant was admitted to interim protection, by making a reference to prima facie case of the prosecution, appeared in the complaint.

Pursuant to the F.I.R., investigation has progressed and it is informed that the person by name Nikhil Tayde, who brought the brown coloured envelope bearing outward number of J.J.Hospital and which was addressed to the Assistant M.M.Salgaonkar

2/2 24 ABA-1475-22.doc Commissioner, Ulhasnagar Municipal Corporation, is no more available for investigation since he is dead. The statements of the three doctors, whose signatures are to be found on the certificate dated 05/08/2020 declaring the applicant to be incapacitated from further employment, are also recorded. The said doctors have denied their signatures and issuance of any such certificate. They have also denied that they ever examined the applicant. The statement of an employee of Ulhasnagar Municipal Corporation is also recorded, who admits that she received the sealed envelope from J.J.Hospital through one Nikhil Tayde.

Since the investigation is now over and the sample signatures of the applicant are obtained, custodial interrogation of the applicant, who is permitted to be retired voluntarily from the Corporation on 24/08/2020, is not required. The order dated 06/06/2022 is made absolute. The applicant shall report to the police station, as and when called for.
