1] By a reasoned Order dated 13th June 2017, the applicant was granted interim relief.

2] Perused the record of investigation.

The record indicates that, there is substance in the contention of the applicant that on 1.7.2016 he was out of station and therefore the allegation of his presence at the shop of the first informant on the date of incident is not correct. The Investigating Officer has verified the said fact. 1/2

aba.896-2017.doc 3] In view thereof, interim relief granted by an Order dated 13th June 2017 is confirmed.

However, the applicant is directed to attend the Investigating Officer as and when called for between 5.00 p.m to 7.p.m till completion of investigation.

4] Application is allowed in the aforesaid terms. 5] In view of Order passed in A.B.A. No.896 of 2017, Criminal Application No.656 of 2017 for intervention does not survive and is accordingly disposed off.
