Heard the learned Counsel for the parties.

The learned Counsel for the applicant, on instruction, seeks leave to withdraw the application.

The learned Counsel for the applicant submits that the applicant is in custody since 14th January, 2018 and the trial has yet not commenced.

Having regard to the nature of the accusation, the age of the victim, the time of the alleged occurrence and the period of incarceration, it may be expedient to commence and conclude the trial as expeditiously as possible. Hence, the 1/2

20-BA1298-2023.DOC learned Special Judge seized with Special Case No.76 of 2018 arising out of CR No.370 of 2017 is requested to make an endeavour to commence and conclude the trial in Special Case No.76 of 2018 as expeditiously as possible and, preferably, within a period of six months from the date of the communication of this order.

The applicant would render the necessary cooperation in conclusion of the trial and shall not seek adjournment. 6.

In the event, the trial is not concluded in the aforesaid period, the applicant shall have the liberty to revive the prayer for bail.
