Heard learned counsel for the applicant and the learned Additional Public Prosecutor for the State. Applicant seeks transit pre-arrest protection in Crime No.241 of 2022 registered at Sidkul Haridwar Police Station, Uttarakhand for the offences punishable under Sections 504, 506 and 387 of the Indian Penal Code, 1860. Applicant is Ph.D. student, resident of Pune. It appears from the averments in the application, that complainant in Crime No.241 of 2022, was applicant's class-mate at Pune. He was also pursuing his Ph.D. Both were in relationship, which soured over a period of time. Applicant herein lodged the complaint against him in November, 2021 whereupon offences punishable under Sections 354-D, 506(II) and 507 of IPC read with Section 67 of the Information Technology Act, 2000 came to be registered against Mr. Viplove Tyagi (Complainant herein). It appears at the instance of Tyagi, Crime No.241 of 2022 came to be registered against the applicant, at Uttarakhand. Applicant is apprehending her arrest in connection with said crime. However, having regard to distance between Pune and Uttarakhand, till the time, she approaches, Court of jurisdiction, in the interest of justice, I am inclined to grant her transit pre-arrest protection, in Shivgan 2/3
exercise of powers under Section 482 read with 438 of the Cr.P.C. till 8th July, 2022. Thus, following order:
ORDER
(i) In the event of arrest of the applicant in Crime No. 241 of 2022 registered with Cidkul, Haridwar Police Station, Uttarakhand, she shall be released on executing PR bond for the sum of Rs.10,000/- with one or more sureties in like sum.
