Heard. The Appeal from Order is preferred by the Plaintiff challenging the order dated 27/07/2015 passed by the Bombay City Civil Court, Mumbai in draft Notice of Motion in L.C.Suit No.1949/2008 declining to grant adinterim relief. 2.

The learned counsel for the Respondent Defendant submits that the L.C.Suit No.1949/2008 itself stood dismissed on 22/07/2014. Till today same is not restored. Considering the subsequent development, nothing survives in the present Appeal from Order.

The learned counsel for the Appellant Plaintiff seeks permission to withdraw the present Appeal from Order with liberty to file appropriate proceedings. Same is granted.
