By this Civil Application, Applicant husband is seeking condonation of 22 days delay in filing Family Court Appeal challenging the judgment and decree dated 01.01.2018 passed by Family Court, Nashik in Petition No.A-189 of 2014 allowing Respondent original petitioner's petition for dissolution of marriage under section 13(1)(ia) of the Hindu Marriage Act, 1956.

20 cam158-18.doc The learned counsel for the Respondent vehemently opposed the present Civil Application. He submits that Applicant has not shown sufficient cause for condonation of delay. Hence, there is no substance in the present Civil Application. Same be dismissed with costs.

Heard.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, we are satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order: a) Delay in filing Family Court Appeal is condoned. b) Civil application stands disposed off accordingly. c) No order as to costs.
