Heard learned counsel for the Applicant and learned A.P.P. for the Respondents / State.

As the Applicant apprehends to be arrested in C.R. No.105 of 2016 registered with Sahar Police Station, Mumbai, for the offences punishable under Sections 326 and 504 r/w. 34 of IPC, he has filed this application for anticipatory bail under Section 438 of Cr.P.C. 3.

It is submitted by learned counsel for the Applicant that other Accused was arrested and released on regular bail. The injury certificate also reveals that only one C.L.W. was caused on the scalp and there was contusion on leg. Hence, charge under Section 326 of IPC is also not attracted. Further it is alleged that the alleged incident had taken place on 1/2 ABA-906-16.doc

13th April 2016 i.e. more than a month back. Injured is also discharged from the Hospital. Most of the investigation is also completed. In view thereof, in my considered opinion, this Anticipatory Bail Application deserves to be allowed. Hence, the order.

"O R D E R"

(i) The Anticipatory Bail Application is allowed. (ii) In the event of arrest of the Applicant - Dilip Shankar Shetty in C.R. No.105 of 2016 registered with Sahar Police Station, Mumbai, he be released on P.R. Bond of Rs.20,000/-, with one or two sureties in the like amount, subject to the condition that he shall not tamper with the prosecution witnesses and shall give attendance at Sahar Police Station, Mumbai, once a week, on Monday, in between 11 am to 2 pm, until filing of the Charge-Sheet.
