This is an application for suspension of substantive sentence of imprisonment imposed on the applicant/accused and for releasing him on bail during the pendency of the appeal filed by him. The applicant/accused is convicted of the offence punishable under Section 307 of the Indian Penal Code as well as avk 1/2

5-APPA-763-2017.doc under Section 30 of the Arms Act. He is sentenced to suffer rigorous imprisonment for 3 years apart from direction to pay fine of Rs.3,000/- and in default, to undergo further rigorous imprisonment for 3 months. On another count, he is sentenced to suffer rigorous imprisonment for 3 months.

Heard both sides.

Substantive sentence of imprisonment imposed on the applicant/accused is already suspended as an interim relief by this court vide order dated 19th May 2017. The same has already been suspended by the learned trial court, upon conviction of the applicant/accused. In this view of the matter, following order :

ORDER

i) The order dated 19th May 2017 is confirmed on same terms and conditions.
