This is an Application for bail in respect of C.R. No. 248 of 2022 registered with Dehu Road Police Station for the offences punishable under Sections 392 read with Section 34 of the Indian Penal Code, 1860 ("I.P.C.").

The F.I.R. is dated 24th April 2022. The Applicant was arrested on 25th April 2022. The Applicant is Accused No.1. There are total eight accused persons.

Ms. Shetty, learned Counsel appearing for the Applicant submitted that all the other Accused have been enlarged on bail either by the learned Sessions Court, Vadgaon or by this Court. 1/4

It is the case of the prosecution that the incident happened on 24th April 2022 at 11.00 am. The informant wanted to withdraw cash from ATM of the Bank. The said ATM was not working and therefore cash could not be withdrawn. At that time, accused snatched the ATM card from the informant. The accused thereafter withdrew an aggregate amount of Rs.1,00,000/- by withdrawing Rs.10,000/- on each occasion by utilising said card and purchased gold ornaments. 5.

There is a recovery at the instance of the present Applicant of said gold ornaments.

It is an admitted position that the Charge-sheet is filed and all muddemal articles are recovered. The accused is in Jail for about 1 year and 6 months.

It is the contention of learned APP that there is another offence registered vide C.R. No. 141 of 2022 with Dehu Road Police Station, Pune for the offence under Section 420 read with Section 34 of the I.P.C. against the present Applicant. Learned APP states that the Applicant has been enlarged on bail in said C.R. The trial is unlikely to be concluded any time soon and will take a considerably long time. Accordingly, the Applicant can be enlarged on bail by imposing conditions. Hence, the following order:- 2/4

O R D E R

(i) The Bail Application is allowed.

(ii) The Applicant-Arvind @ Deepak Kumar Sing is released on bail in connection with C.R. No.248 of 2022 registered with Dehu Road Police Station, District PimpriChinchwad for the offence punishable under Sections 392 read with Section 34 of the Indian Penal Code, 1860 on furnishing P.R. bond of Rs.25,000/- with one or two local sureties.

(iii) The Applicant shall report to the Investigating Officer of the concerned Police Station once in a month on every first Sunday of the month between 11.00 am. and 1.00 pm.

(iv) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing the facts to Court or any Police Officer. The Applicant shall not tamper with the evidence. (v) On being released on bail, the Applicant shall furnish his contact number and residential address to the 3/4

Investigating Officer and shall keep him/her updated, in case there is any change.

(vi) The Applicant shall attend the trial regularly. The Applicant shall co-operate with the trial Court and shall not seek unnecessary adjournments.
