The applicants are seeking anticipatory bail in connection with CR No.88 of 2017 registered with Borivali Police station for the offences punishable under section 498A, 403, 406, 420, 465, 468 and 470 read with 34 of IPC.

The FIR was registered at the instance of the complainant on account of matrimonial dispute. The applicant no.1 was arrested during pendency of this application. The applicant no.2, 3 and 4 granted interim protection by this Court vide order dated 26 May, 2017.

Learned advocate for the applicant submitted that applicant no. 1 was produced before concerned Court after his arrest and he has been granted bail. He further submitted that the dispute between the complainant and the accused has been settled. The said fact is reflected in order granting bail dated 7 June, 2017 passed by the Metropolitan Magistrate, 26th Court, Borivali, Mumbai in respect to the arrested accused. The complainant is present in Court and she has not disputed the fact that there is settlement between the parties. 4.
In view of the above, I pass the following order. :: ORDER ::
(i) Anticipatory Bail Application no.903 of 2017 is allowed. (ii) Interim protection granted vide order dated 26 May, 2017 is hereby confirmed.
(iii) Application is disposed of.
