1) The petitioner has challenged the order dated 8.5.2017 passed by the Returning Officer appointed to conduct the elections of the Malegon Municipal Corporation. The nomination form of the petitioner is rejected on the ground that there is material variance in the name of the petitioner and the name appearing on the documents submitted in support of her identity and other claims.

2) We have perused the record. The petitioner contends that her name is as stated in the cause title of the petition. However. while filling up the nomination form and other documents she has annexed the documents in the name of Khan Abdul Hamid. The said name is also reflected in the final voters list at Sr. 7227. 3) After perusing the record we are of the considered view that there is no illegality or perversity in the impugned order passed by the Returning Officer. The petition is dehors of any merits and is accordingly rejected.
