DATED : 14th JUNE, 2022 P.C:- By the present application, the applicant seek return of the passport which was directed to be surrendered to the Investigating Officer by order dated 13/4/2018. My attention is invited to an order dated 8/4/2022 when the protection from arrest granted in favour of the applicant was confirmed, on the statement being made by the learned APP that his custodial interrogation is not warranted and the chargesheet is already filed. 2/2 7 IA 1703-22.doc The said order do not impose any condition about surrender of passport or retaining the passport which was surrendered earlier.
Mr.Gavand, the learned APP state that on completion of investigation, the Investigating Officer has no hesitancy in returning the passport.
The Investigating Officer shall return the passport to the present applicant within one week from today. Application stand disposed off.
Needless to state that the applicant make a statement that since passport has expired. He is at liberty to prefer an application before the Magistrate for it's renewal, once it is received.
