In view of the fact that, the Petitioner has already filed an Application for discharge before the trial Court, the present Petition for quashing of Sessions Case No.115 of 2021 arising out of C.R. No.430 of 2018 registered with Kashimira Police Station, Thane (Rural) does not survive. 2.

In view thereof, learned counsel for Petitioner on instructions seeks leave to withdraw present Petition with liberty to pursue his application for discharge before the trial Court.

Leave and liberty granted.

Petition is disposed off as withdrawn with aforesaid liberty. 4.
