Heard learned Counsel for the parties.

Learned Counsel for the applicant seeks modification of the condition set out in clause - (i) of para 5 of the order dated 1st September, 2017, passed by this Court, in Criminal Bail Application No.1373 of 2017.

The condition of which modification/relaxation is sought, reads thus:- "5.

....

(i) The Applicant be enlarged on bail, on executing PR Bond in the sum of Rs.30,000/- with one or two local solvent sureties in the like amount."

Learned Counsel for the applicant submits that although the applicant was enlarged on bail vide order dated 1st September, 2017, he is, still in custody, as he is unable to execute PR Bond in the sum of Rs.30,000/- with one or two local solvent sureties in the like amount, till date. He submitted that the applicant be released on temporary cash bail or in the alternative, the surety amount be reduced from Rs.30,000/- to Rs.15,000/-.

Learned APP has no objection if the said condition is modified.

For the reasons set out in the application, the application is

3/3 allowed and the condition set out in clause - (i) of para 5, imposed by this Court, in Criminal Bail Application No.1373 of 2017, stands modified. 7.

Accordingly, the Applicant shall now be enlarged on bail, on executing PR Bond in the sum of Rs.15,000/- with one or two local solvent sureties in the like amount. Rest of the conditions imposed vide order dated 1st September, 2017, to remain as it is. 8.

The Application is allowed and disposed of in above terms. 9.
