After arguing for some time, the learned advocate for the applicant on instructions sought liberty to withdraw the application. He further submitted on instructions that the applicant would appear before the concerned Magistrate on or before 12th June, 2017. He relied upon the order dated 1st February, 2017 passed by this Court in respect to the application preferred by accused Harshad Patil. The said order was passed in anticipatory bail application no.2195 of 2016. The applicant therein was permitted to withdraw the application and was protected for a limited period till he surrenders before the concerned Court.
rpa 2/2 aba-912-17.doc Learned counsel appearing for the applicant therefore submitted that similar order be passed in the present application. He further submitted that he may be protected from arrest till he surrenders before the Court.
In view of the aforesaid submissions, the liberty as prayed for is granted. Protection as prayed for is granted to the applicant till 5.00 p.m. of 12th June, 2017. The application, if any, preferred by the applicant while surrendering be dealt with in accordance with law and on merits.
Anticipatory Bail Application stands dismissed as withdrawn and disposed of accordingly.
