When this matter was placed before us, on instructions, Mr. Mali says that the Scrutiny Committee (Respondent No.2) situate at Nagpur will endeavour and conclude the proceedings before it as expeditiously as possible and, in any event, within two months from today. We accept this statement SRP 1/2

(901)ASWP7017.18.doc as an undertaking to this Court. We direct that the proceedings be concluded within two months. Under no circumstances, we will extend the time to complete the same. In the event the petitioner is a bona fide student of the fourth respondent-Institute for the second year of the BDS course, has appeared and taken the examination of the second year BDS course, then, the respondent No.5-University shall, after ascertaining this fact, declare his result. After the result is declared and it is duly communicated, all necessary consequences in law shall follow. The writ petition is disposed of by clarifying that we have not examined the rival contentions. Merely because the petitioner has cleared the examination and now has progressed to the third year BDS course will not mean that he can claim any equities on the strength of our order.
