This Arbitration Petition has been filed by the Petitioner under section 11(5) of the Arbitration and Conciliation Act, 1996 for appointment of Arbitrator to adjudicate the dispute between the parties. Learned Counsel for the Petitioner and learned Counsel for the Respondent are agreed to the appointment of a former Judge of this Court as Arbitrator. However both the parties are unable to arrive at a consensus in suggesting the name of the Arbitrator and have left it to the Court to appoint the Arbitrator. In the circumstances, I pass the following order:

O R D E R

a) Justice Dr. S. Radhakrishnan (Retd.), Flat No.15, "Yashodhan", Dinshaw Vachha Road, Churchgate, Mumbai 400 020 is appointed 1/2

k 2/2 917 arp 49.14 as .doc as sole Arbitrator to arbitrate the dispute between the parties under the Arbitration & Conciliation Act, 1996.
