The application is moved for pre arrest bail. One Prajakta Chandrakant Bhosale is the complainant who gave information to police and pursuant to which the offence was registered at C.R. No. 8 of 2014 with Dighi police station, Pune under Sections 326, 324, 323 and 504 read with 34 of the Indian Penal Code.

It is the case of the complainant that the land of the father of the complainant and the applicant/accused is adjacent. On 2nd December, 2014 she along with her father went to their field for the purpose of measurement and to take photographs. At that time, her father told the 1 / 3

owner of the adjacent land i.e. co-accused Kumar Bengle to remove the stones which were lying on their plots. At that time, some altercations took place between them. It is the case of the complainant that the applicant herself and her mother caught hold her heirs and dragged and beat her. One of the co-accused threw stones at the complainant which hit on the head and forehead of the complainant and due to it she sustained injuries. Hence, the offence was registered under Sections 326, 324, 323 and 504 read with 34 of the Indian Penal Code.

Perused the first information report. Perused the injury certificate. There is no fracture caused to the complainant. The learned prosecutor opposed the application. However, in view of the allegations made by the complainant and the injuries sustained to her and the nature of the offence, I am inclined to grant pre arrest bail. 4.

Hence, I grant anticipatory bail as under:

a) In the event of arrest, the applicant/accused be enlarged on bail upon furnishing P. R. Bond in the sum of Rs. 15,000/- (Fifteen Thousand) with one or two solvent surety/s in the like amount; b) The applicant/accused shall attend the concerned police station on 2nd July, 2015 in between 10.00 am to 11.00 am. 2 / 3

c) The applicant/accused shall not indulge in any criminal activity i.e. quarrel, fight or assault with the complainant or her family members.
