The advocate appointed for the applicant is not present. The co-accused in the present case i.e. C.R. No. 295 of 2012 had filed Cr. B.A. No. 89 of 2014. The said application was rejected by the Coordinate bench (Coram : Revati Mohite Dere, J) vide order dated 29th April, 2015. The Hon'ble Judge has specifically observed in paragraph-4 that overt act is attributed to the present applicant, such as Pravin came from behind and throttled her neck, the victim hit Pravin and pushed him away, however, Pravin held her again. 19.ba1015.15.sxw alleged that as she was trying to shout present applicant-Pravin sat on her and gagged her mouth. In view of this, the application being sans merit deserves be rejected.
