DATE: SEPTEMBER 19, 2022 P.C.:- 1] Applicant is seeking pre-arrest bail in C.R. No. 267 of 2022 registered with Indapur Police Station, Indapur for the offence punishable under Sections 324, 326, 354, 143, 147, 327, 148, 149, 323, 504, 506 of the Indian Penal Code.

2] Learned APP would oppose the prayer on the ground that custodial interrogation of the Applicant is required for recovery of gold ornaments and the Applicants have not cooperated in the investigation.

45 ABA-1487-22.doc 4] Allegations against Applicants are, use of stones and sticks in the commission of offence. The dispute pertains to right of way and at the behest of the Applicants counter offence is registered which is punishable under Sections 327, 324, 506 of the Indian Penal Code. 5] In the aforesaid backdrop, considering the nature of injuries suffered and allegations made, it will be appropriate to confirm the ad-interim protection ordered on the following conditions. 6] Applicants in the event of their arrest in C.R. No.267 of 2022 registered with Indapur Police Station, Indapur for the offence punishable under Sections 324, 326, 354, 143, 147, 327, 148, 149, 323, 504, 506 of the Indian Penal Code, be released on bail on executing P.R. Bond of Rs 15000/- each with one or more sureties in the like amount.

Applicants shall neither influence the witnesses in any manner nor tamper with the evidence. Till charge-sheet is filed, Applicants shall remain outside the jurisdiction of the Indapur Police Station but for attending the said Police Station. Applicants shall attend the Investigating Officer of the Indapur Police Station from 26th September, 2022 to 30th September, 2022 between 10.00 A.M. and 12.00 Noon and thereafter as and when directed by the Investigating Officer.
