By this Application, the Applicant seeks condonation of delay of 104 days in filing the aforesaid Application seeking leave to file an Appeal.

Learned counsel for the Respondent No.2

APPLN 321-15.doc has filed an Affidavit-in-reply of the Respondent No.2 opposing the said delay condonation Application.

Perused the Application and the reply affidavit.

For the reasons set out in the Application, in particular, paras 3 to 10, the Application is allowed and the delay of 104 days in filing the aforesaid Application seeking leave to file an Appeal is condoned.

Accordingly, the Application is disposed of. The Criminal Application seeking leave to file an Appeal to be listed after two weeks.
